    HE DISREGARDED FINANCIAL RULES AND PROCEDURES

    GOVERNMENT GOT THE PROOFS OF HIS FINANCIAL MISMANAGEMENT.

    AUDIT REPORT PROVIDES THE RECORD OF ABUSE OF AUTHORITY AND FUNDS OF THE GRANTS RELEASED IN NAWAZ RULE.

    There is an official evidence of the disregard of financial rules / procedures, financial mismanagement, abuse of authority and funds of the grants released by the Ex Prime Minister Nawaz Sharif for cherishing the persons of media. I am not using my own words.

    The all I am writing is the text of the Special Audit Report prepared by the Directorate General of Audit (FG) Department of the Auditor General of Pakistan. The report is on:

    Establishment of Funds for the Welfare of Pakistan Movement Workers.
    Islamabad Policy Research Institute.
    Prime Ministerís Literacy Award 1997 Ceremony.
    Pakistan Publicity on Internet.
    The context of the report is as under: -

    In pursuance of the Auditor-General of Pakistanís instruction issued on the requisition of Secretary General Ministry of Finance vide their U.O.No.F-5 (6) Exp.11/2000-61 dated 28-01-200, the special audit of accounts / expenditure of certain grants given to the Ministry of Information and Media Development during 1997-98 and 1998-99, was conducted by an Audit Team headed by Syed Ghazanfar Abbas Gilani, Director (Audit), M/S Yousaf satti, Deputy Director (Audit), Abdur Rasheed Khan Swati, Audit Officer assisted as member of the Team during 01-02-2000 to 25-02-2000.

    2. Following four grants were released by Ministry of Finance: -

    Grant of Rs. 25.00 million for establishment of fund for the Welfare of Pakistan Movement Workers 1997-1998.
    Grant of Rs. 15.00 Million for establishment of Islamabad Policy Research Institute (IPRI).
    Grant of Rs. 5.00 million for organizing Prime Ministerís Literacy Award Ceremony on November 15-17-1998.
    Grant of Rs. 560.000 for the creation of Internet Wing in the Ministry of Information and Media Development.
    3- The Ministry of Information and Media Development was responsible for

    the implementation of the proposal execution of grants.

    4- In record relating to the expenditure of grant Rs.25.00 million the fund for the Welfare of Pakistan Movement Workers was not provided.

    5- From the examination of the record which was produced the following major issues were emerged.

    . Financial mismanagement.

    . Disregard to financial rules / procedures.

    . Misuse of funds.

    6- The details of financial lapses / irregularities are highlighted in the Audit Report. The view point of the Ministry of Information and Media Development emerging from the replies were furnished in response to audit queries was incorporated in the report.

    Chapter-1

    ESTABLISHMENT OF FUND FOR THE WELFARE OF PAKISTAN MOVEMENT WORKERS.

    In the first week of august 1997. Mr. Mushahid Hussain Syed, the then advisor, to the Prime Minister, on information had proposed the establishment a Freedom Fighter Fund by the government with an initial allocation of Rs. 50.000 million for the welfare of the Freedom Fighters who are still alive as well as the families of deceased workers who may be offered stipends and other kind of financial support including medical assistance.

    The fund would help in promoting awareness of the Pakistan Movement through publication of profiles and printing material regarding the role and contribution of the different Freedom Fighters. National Committee with the representation of all sections of Pakistan Society as well as Provinces was to be constituted under Ministry of Information & Media Development. However, on the recommendation of Finance Minister the title of the fund was changed as "Fund for the Welfare of Pakistan Movement Workers" and Mr. Majeed Nizami, Chief Editor Nawa-e-waqt Group of Newspapers was to head the committee set-up for administering the Fund.

    During his address to the Golden Jubilee Celebration in Lahore, on 15-8-1997 the Prime Minister announced the establishment of a fund for the Welfare of Pakistan Movement Workers with an allocation of Rs. 50.000 million.

    In view of financial constraints a supplementary grant of Rs. 25 million was sanctioned to the Ministry of Information and Media Development under Demand No. 76. Of Ministry of Information & Media Development (Main Secretariat), during 1997-98. The remaining amounts of Rs. 20.000 million and 5.000 million were proposed to be provided during 1999-2000 respectively.

    However the same could not be released due to non-fulfillment of pre-requisite i.e. legal formalities of operation of Fund.

    In pursuance of Ministryís sanction No. (9)/96-97/ Budget dated 26-03-1998, a cheque bearing No. G517652 dated 28-28-03-1998 for Rs. 25,000 million in the name of Welfare of Pakistan Movement Workers Fund Lahore was issued by AGPR Islamabad.

    The Ministry on collection transferred a cheque to Special Assistant to Finance Minister through DFA (I&MD) on 28-03-12998 for delivery to Mr. Majid Nizami a trustee of the fund. The cheque was deposited by him as fixed deposit in PLS Account No. 940-4 with Bank of Punjab Secretariat Branch Lahore.

    As per decision taken, Pakistan Movement Workers Fund, the trust with the approval of Board of Trustee was to spend only the profit on the Welfare of Workers and would arrange for annual audit. Since the incurring of expenditure out of profit has started from July 1998 it transpired from the record of Ministry that the amount of Rs. 25.000 million had been transferred to the fund for Welfare of Pakistan Movement Workers without meeting the pre-requisite of fund i.e. legal as well as other formalities as enumerated below: -

    1) Enactment of creation of Fund by the Parliament.

    2) Notification of setting up of committee / to man the trust and its members including functions of the entity.

    3) Formulation and finalization of modalities for the opening of funds.

    4) Preparation of financial accounting procedure.

    Due to these shortcomings the Ministry of Finance did not release the balance amount of the Trust. Moreover the status of balance of PLS Account No. 940-4, statement of expenditure incurred during July 1998 to December 1999 and a copy of Audit report has not been provided to audit.

    The release of Rs. 25.000 million for the Fund for Welfare of Pakistan Movement Workers has been held as unauthorized in view of above mentioned lapses (1-4). Audit would suggest that either the amount should be retrieved and deposited into government account or the enactment of fund or notification of Trustees arranged besides completion of other formalities.

    IRREGULAR RELEASE OF RS.25/- MILLION FOR THE WELFARE OF PAKISTAN MOVEMENT WORKERS FUND.

    During the scrutiny of record of the ministry that a sum of Rs. 25 million had been sanctioned vide No. 1 (19)/96-97 Budget dated 26-3-1998 and drawn through cheque No. G-517652 dated 28-3-98. The cheque was handed over to Mr. Majid Nizami, Editor-in-Chief of Nawa-e-waqt Group of Publications who was neither Chairman nor Secretary of the proposed trust. This amount was deposited in the Bank of Punjab by Majid Nizami and the details incurred have not been provided to the Ministry of Information and Media Development as required by Finance Division. Thus the Release of Funds is therefore held irregular due to the following: -

    The enactment for the creation of Pakistan Movement Workers Welfare Fund has not been arranged, as the Ministry was responsible for the enactment of the Trust/Fund.
    Release of public fund to private entity without the approval of the legislature can not be admitted as valid transaction.
    Maintaining a commercial bank account without the concurrence of the Finance Division is violation of para 7 of GFR vol. 1.
    The constitution and formation of the trust has not been notified by the Ministry of Information and Media Development. In the absence of notification for establishment of the Trust all the operations carried so far can not be considered valid. Moreover government funds can neither granted nor handled by person not notified as such.
    UNAUTHORIZED PAYMENT OF RS. 590,000/- TO NON RELATED PERSONS

    During the scrutiny of paid vouchers of Islamabad Policy Research Institute (IPRI) for 98-2000 it was noticed that Rs. 590,000 as per detailed below were paid to six private persons not related to IPRI. Thus payment maid is held unauthorized & recoverable.

    1- Mr. Rafiq Ghori Editor in GNN Rs. 100,000

    2- Mr. Asadullah Ghaib Rs. 100.000

    3- Dr. Shirin Mazari Rs. 250,000

    4- Mr. Irfan Ghazi Rs. 50,000

    5- Miss. Shumaila Muddasr Jafferi Rs.50,000

    6- Mr. Khalil Malik Rs.50,000

    In support of the payment nothing was available which could justify the expenditure from the budget of IPRI. Thus the payment made is a violation of para 9-10-12 of G.F.R. VOL-1 & also an act of abuse of authority & misuse of public funds.
